{"id":7125,"date":"2016-04-02T09:38:31","date_gmt":"2016-04-02T14:38:31","guid":{"rendered":"http:\/\/colegiocolombianodecontadores.com\/?p=7125"},"modified":"2017-02-04T21:58:58","modified_gmt":"2017-02-05T02:58:58","slug":"resolucion-974-marzo-18-2016-ministerio-de-salud-y-proteccion-social-formulario-unico-de-afiliacion-y-registro-de-novedades","status":"publish","type":"post","link":"https:\/\/contadoreshoy.com\/?p=7125","title":{"rendered":"RESOLUCION 974 MARZO 18 2016 MINISTERIO DE SALUD Y PROTECCION SOCIAL &#8211; FORMULARIO \u00daNICO DE AFILIACI\u00d3N Y REGISTRO DE NOVEDADES"},"content":{"rendered":"<p style=\"text-align: center;\"><strong><a href=\"https:\/\/www.minsalud.gov.co\/Normatividad_Nuevo\/Resoluci%C3%B3n%200974%20de%202016.pdf\" target=\"_blank\">RESOLUCI\u00d3N N\u00daMERO 0974 DE 2016<\/a><\/strong><\/p>\n<p style=\"text-align: center;\">(marzo 18)<\/p>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\"><em>por la cual se adopta el Formulario \u00danico de Afiliaci\u00f3n y Registro de Novedades\u00a0 al Sistema General de Seguridad Social en Salud.<\/em><\/span><\/p>\n<p style=\"text-align: justify;\">El Ministro de Salud y Protecci\u00f3n Social, en ejercicio de sus facultades legales, en especial las conferidas en el art\u00edculo 2\u00b0 del Decreto-ley 4107 de 2011, el par\u00e1grafo 4\u00b0 del art\u00edculo 16, y los par\u00e1grafos de los art\u00edculos 44, 47, 53, 55 y 56 del Decreto 2353 de 2015 y<\/p>\n<p style=\"text-align: center;\">CONSIDERANDO:<\/p>\n<p style=\"text-align: justify;\">Que mediante el Decreto 2353 de 2015, el Gobierno nacional unific\u00f3 y actualiz\u00f3 las reglas de afiliaci\u00f3n al Sistema General de Seguridad Social en Salud, cre\u00f3 el Sistema de Afiliaci\u00f3n Transaccional y defini\u00f3 los instrumentos para garantizar la continuidad en la afiliaci\u00f3n y el goce efectivo del derecho a la salud.<\/p>\n<p style=\"text-align: justify;\">Que seg\u00fan lo establecido en el art\u00edculo 16 del citado decreto, la afiliaci\u00f3n al Sistema General de Seguridad Social en Salud se efect\u00faa con el registro en el Sistema de Afiliaci\u00f3n Transaccional y la inscripci\u00f3n a una sola Entidad Promotora de Salud, mediante la suscripci\u00f3n del formulario f\u00edsico o electr\u00f3nico que adopte el Ministerio de Salud y Protecci\u00f3n Social.<\/p>\n<p style=\"text-align: justify;\">Que el par\u00e1grafo 4\u00b0 del precitado art\u00edculo dispone que, hasta tanto entre en operaci\u00f3n plena el Sistema de Afiliaci\u00f3n Transaccional, la afiliaci\u00f3n y las novedades de traslado y de movilidad deber\u00e1n realizarse en el formulario f\u00edsico que, para el efecto, adopte el Ministerio de Salud y Protecci\u00f3n Social.<\/p>\n<p style=\"text-align: justify;\">Que se hace necesario adoptar el formulario f\u00edsico a trav\u00e9s del cual se llevar\u00e1 a cabo el proceso de afiliaci\u00f3n y registro de novedades al Sistema General de Seguridad Social en Salud.<\/p>\n<p style=\"text-align: justify;\">En m\u00e9rito de lo expuesto,<\/p>\n<p style=\"text-align: center;\">RESUELVE:<\/p>\n<p style=\"text-align: center;\">\n<p style=\"text-align: justify;\">Art\u00edculo 1\u00b0. <em>Objeto<\/em>. <span style=\"color: #ff9900;\">La presente resoluci\u00f3n tiene como objeto adoptar el Formulario \u00danico de Afiliaci\u00f3n y Registro de Novedades al Sistema General de Seguridad Social en Salud, y las instrucciones para su diligenciamiento contenidos en los <strong>Anexos T\u00e9cnicos N<\/strong>\u00b0<strong> 1: \u201cFormulario \u00danico de Afiliaci\u00f3n y Registro de Novedades al Sistema General de Seguridad Social en Salud\u201d y N<\/strong>\u00b0<strong> 2: \u201cInstructivo para el Diligenciamiento del Formulario \u00danico de Afiliaci\u00f3n y Registro de Novedades al Sistema General de Seguridad Social en Salud\u201d,<\/strong> los cuales forman parte integral de la misma. Igualmente, describir su contenido, establecer su obligatoriedad y transitoriedad para su aplicaci\u00f3n en todo el territorio nacional.<\/span><\/p>\n<p style=\"text-align: justify;\">Art\u00edculo 2\u00b0. \u00c1mbito de aplicaci\u00f3n. La presente resoluci\u00f3n aplica a las Entidades Obligadas a Compensar (EOC), Entidades Promotoras de Salud (EPS) de los reg\u00edmenes contributivo y subsidiado, a los empleadores y otros aportantes, entidades responsables de la afiliaci\u00f3n colectiva, institucional y de oficio, a las entidades territoriales, a las personas y a los afiliados cuando deban registrar la afiliaci\u00f3n o reportar novedades en el Sistema General de Seguridad Social en Salud, hasta tanto entre en plena operaci\u00f3n el Sistema de Afiliaci\u00f3n Transaccional.<\/p>\n<p style=\"text-align: justify;\">Art\u00edculo 3\u00b0. <em>Obligatoriedad<\/em>. Las EOC y las EPS de los reg\u00edmenes contributivo y subsidiado deber\u00e1n utilizar y disponer obligatoriamente el formulario adoptado con la presente resoluci\u00f3n y su contenido no podr\u00e1 ser modificado ni adicionado con nueva informaci\u00f3n. Cualquier modificaci\u00f3n al contenido del formulario se tendr\u00e1 por inexistente y no ser\u00e1 oponible para el reconocimiento de la Unidad de Pago por Capitaci\u00f3n (UPC). Lo anterior, sin perjuicio de las acciones de inspecci\u00f3n, vigilancia y control de la Superintendencia Nacional de Salud.<\/p>\n<p style=\"text-align: justify;\">Art\u00edculo 4\u00b0. <em>Contenido del formulario.<\/em> El formulario contiene los datos organizados en una secuencia que busca facilitar al afiliado su diligenciamiento y se acompa\u00f1a de un instructivo que orienta el adecuado tr\u00e1mite de la afiliaci\u00f3n y de las novedades para su registro y reporte.<\/p>\n<p style=\"text-align: justify;\">Art\u00edculo 5\u00b0. <em>Prohibiciones<\/em>. Bajo ninguna circunstancia las EOC y EPS podr\u00e1n anexar al Formulario \u00danico de Afiliaci\u00f3n y Reporte de Novedades al Sistema General de Seguridad Social en Salud, adoptado mediante la presente resoluci\u00f3n, declaraciones del estado de salud, so pena de las sanciones a que haya lugar por parte de la Superintendencia Nacional de Salud.<\/p>\n<p style=\"text-align: justify;\">Art\u00edculo 6\u00b0. <em>Implementaci\u00f3n<\/em>.<span style=\"color: #ff9900;\"> El Formulario \u00danico de Afiliaci\u00f3n y Reporte de Novedades al Sistema General de Seguridad Social en Salud deber\u00e1 ser implementado por las EOC y EPS de los reg\u00edmenes contributivo y subsidiado a m\u00e1s tardar el 2 de mayo de 2016. Hasta tanto se implemente el citado formulario, las EOC y EPS podr\u00e1n utilizar los formularios existentes y para registrar y reportar la novedad de movilidad, deber\u00e1n identificarla en la casilla de novedades bajo el n\u00famero \u201c99\u201d o la palabra \u201cMOV\u201d.<\/span><\/p>\n<p style=\"text-align: justify;\">Art\u00edculo 7\u00b0. <em>Inspecci\u00f3n, vigilancia y control<\/em>. Corresponder\u00e1 a la Superintendencia Nacional de Salud, efectuar la Inspecci\u00f3n, Vigilancia y Control a la aplicaci\u00f3n de las disposiciones aqu\u00ed previstas.<\/p>\n<p style=\"text-align: justify;\">Art\u00edculo 8\u00b0. <em>Vigencia<\/em>. La presente resoluci\u00f3n rige a partir de su publicaci\u00f3n y deroga las Resoluciones 5602 de 2015 y 560 de 2016.<\/p>\n<p style=\"text-align: justify;\">Publ\u00edquese y c\u00famplase.<\/p>\n<p style=\"text-align: justify;\">Dada en Bogot\u00e1, D.
